By creating an account on PrinTribe.com, you are agreeing to this PRINT ON DEMAND FULFILLMENT SERVICES AGREEMENT (the "Agreement") between PrinTribe Pty Ltd ("PrinTribe") and the User ("You").


Definitions

Agreement’ is collectively all the terms and conditions, rules and policies and procedures referenced or contained in this document (Terms of Service) including but not limited to payment, shipping, and refunds.

Artwork’ refers to digital imagery uploaded by You to our Website including but not limited to digital illustration, art, photography, and scanned imagery.

Content’ refers to content featured or displayed throughout the Website, including but not limited to text, graphics, video, illustrations, design and features available on the Website or via our service.

Customers’ any person or organisation who purchases Your products through Your sales channels.

Orders’ refers to products created by You on our Website which have been submitted for production.

Fulfilled orders’ products created by You on our Website and which have been produced and shipped.

Products’ products created by You by uploading Your artwork and using the services on our website.

Providers’ any company PrinTribe partners with to provide our service to You.

Sales Channels or Stores’ refers to websites, online stores or other online platforms used by You to sell Your products.

Service’ refers collectively to any services rendered within the scope of providing print on demand services to You via our Website including but not limited to software access, membership, printing, framing, and shipping.

Us, We’ refers to PrinTribe PTY LTD, as well as our directors, subsidiaries, contractors, licensors, officers, agents, and employees.

User, You, Your’ refers to the individual person, company, or organisation that has visited or is using the Website or Service; that accesses or uses any part of the account; or that directs the use of the account in its intended function.

Website’ PrinTribe’s website printribe.com, subdomains such as ask.printribe.com, blog.printribe.com, and all content, services and products provided by PrinTribe through Website plugins and API integrations.

Your content’ is content that You create or own.

General

When you use our Website and Services you are agreeing to our Terms of Service, our Privacy Policy, and any other polices referenced or contained below.

How does it work?

You engage PrinTribe by signing up for a PrinTribe account to create and submit products for production and fulfilment using PrinTribe’s website and services. All orders must be placed using the PrinTribe interface, or by other methods approved by PrinTribe, must be in accordance with PrinTribe’s specifications and are subject to the Terms of Service contained in this document.

Usage Restrictions & Prohibited usage

You may only use the site for lawful purposes in accordance with these terms of use.

PrinTribe reserves the right to terminate Your account if You operate this account in violation any of the items contained within this Terms of Agreement.

Copyright

We disclaim any responsibility or liability for copyrighted materials posted on the Website or through our Services. If you believe that your work has been copied in a manner that constitutes copyright infringement, please contact info@printribe.com.

We respect the intellectual property rights of others and expect our users to do the same. In accordance with The Copyright Act 1968 (Cth), we will respond promptly to notices of alleged infringement that are reported to our designated copyright agent.

Orders

PrinTribe will be responsible for producing orders correctly according to the data received.

Order Placement.

All orders with PrinTribe must be placed through the PrinTribe print-on-demand portal. Orders are regarded as being placed with PrinTribe by You, and not by your Customer. Artwork is to be submitted only in electronic formats approved by PrinTribe. These formats are considered to be industry standard.

Order Acceptance.

PrinTribe may refuse to accept any Order if PrinTribe believes:

  • the Artwork contravenes any applicable laws, including but not limited to, reasonable standards of decency
  • the Artwork violates the privacy rights, proprietary rights or intellectual property rights of any person or entity.
  • the Artwork resolution contravenes the recommended resolution. In the event PrinTribe agrees to print the Artwork, PrinTribe will not be held liable for the quality of the final product.

If PrinTribe refuses to accept any Order, You will be promptly notified.

Note: PrinTribe is unable to guarantee a 100% colour match as many factors influence the final appearance of colours on printed media. Colour represented on your computer may render differently when printed even if you have configured the colour space on your monitor. Minor differences in batches of inks and papers can also influence the final outcome.

Pricing

Prices are inclusive of PrinTribe’s standard product packaging. In addition, PrinTribe may, from time to time increase its prices as a result of cost increases affecting PrinTribe’s performance.

Payment

Payment is due at the checkout via any of the payment methods provided. PrinTribe uses a PCI compliant third-party payment gateway as its inbuilt credit card payment gateway. For further information regarding our payment system refer to our Privacy Policy.

Fulfilment

PrinTribe agrees to produce your created products and ship them to your Customer. All received orders will be produced and shipped within seven (7) business days. The day the Order is received is day zero.

Order Cancellations

Once an order has been produced, it may not be cancelled.

If the order has not been shipped, shipping may be cancelled but the order will still be billed.

Change of Address

A change of address can only be made if production has not commenced. If a change of address is required, please contact info@printribe.com.

Due to regional fulfilment, a change of address can only be made if the new address resides in the same region/territory as the original address.

If the request does not adhere to either of the above rules, a new order will need to be placed with updated address information.

Shipping Charges.

Shipping charges for Orders are calculated based on the Products selected and destination of the products and may be amended by PrinTribe at any time.

Claims & Return Policy

Claims resulting from manufacturing or shipping issues; please email PrinTribe Customer Service with supporting photos of both the damaged items and the packaging to info@printribe.com:

1. Within 72 hours from receipt of delivery.

2. When order has been deemed “lost in transit” (typically after 14 days for standard shipping services)

Undeliverable Addresses

Orders in which the address is undeliverable by the carrier will be returned to PrinTribe by the carrier. In these cases, do not submit a new order with the same address.

Delivered to wrong address

Orders delivered to the wrong address where an incorrect address was supplied is deemed to have been fulfilled and a new order will need to be created.

Orders Lost in Transit

For orders “lost in transit,” a new order needs to be resubmitted. Email info@printribe.com to receive a credit for the “lost in transit” order.

Orders damaged in transit, please contact info@printribe.com with supporting photos of both the damaged items and the packaging.

Orders Returned by the Carrier

For Orders returned to PrinTribe by the carrier we will contact you to confirm an address for reshipment. You will be liable for reshipment costs to yourself, or to a confirmed updated address.

Where you elect not to provide a reshipping address, we will dispose of your artwork in a manner that ensures your artwork will not find its way to unintended recipients.

Warranties

PrinTribe warrants that Products will conform to the specifications provided in the Order.

Excepting the previous statement, no representation or warranty, express or implied, is made with respect to Products, and PrinTribe disclaims any and all other representations or warranties, express or implied, including without limitation any representation or warranty as to merchantability or fitness for a particular purpose.

Refunds

If any Product doesn’t conform to the specifications provided in the Order, or PrinTribe fails to produce and ship Products in accordance with the terms of any Order, We shall, either ship a replacement for any Product that does not conform to the original Order terms, or credit You with the purchase price, plus shipping and handling costs, of the non-conforming Products (if payment has already been made).

The refund terms set out in this section are the only remedies for any claim You may have arising under these Terms of Service.

We shall not be considered liable for any special, indirect, incidental, consequential, or punitive damages arising from or in connection with the Order, or these Terms of Service.

Limitations of Liability

PrinTribe shall be held harmless from and against any liability, damage, loss, cost or expense (including reasonable attorneys’ fees incurred) arising out of any claim by You, your Customers or any third party for damages or remedies beyond what is provided in this Terms of Service (including and without limitation, any claim arising out of any Order rejected by Us.

Force Majeure (Acts of God).

In respect of the seven business days production and dispatch of Your Order, PrinTribe shall not be held liable or responsible for any delays due to strike, riots, embargoes, acts of God, war, terrorism, or other causes which are unforeseen, unavoidable, and beyond PrinTribe’s reasonable control.

This includes but isn’t limited to, governmental actions or restrictions imposed upon PrinTribe, You, our Providers, or Our business in connection with an epidemic or pandemic (collectively “Force Majeure Events”). However, none of these events shall excuse Your failure to pay any amounts due to PrinTribe for Services rendered.
